These terms and conditions of service together with any terms and policies referred to in them ("Our Terms") constitute a legally binding agreement between you and Simply Mint Massage ("Simply Mint Massage", "we", "us" or "our").

Simply Mint Massage is a registered business name of a private limited company and our registered ABN is 60 616 943 474 .

OUR SERVICES

Our services are not a substitute for medical attention, treatment, examination, advice or diagnosis. You are responsible for consulting a doctor before commencing any new regimes or alterations to your diet or health. You take full responsibility for making the informed decision to use our Services. You hereby agree to irrevocably release and waive any claims you may have now or in the future against us.

USE OF OUR SITE

Our Terms govern your use of our website (“ Our Site ”) and our booking services (collectively “ Our Booking Services ”). By using Our Site or Booking Services, you agree to abide by Our Terms. Please read Our Terms carefully and thoroughly. If you do not accept Our Terms, you must not make a booking through Simply Mint Massage for any Massage Treatment.

Disclaimer

To the fullest extent possible at law, we exclude any and all liability to you or anyone else for loss or damage of any kind or nature relating in any way to the Website including, but not limited to, loss or damage you might suffer as a result of: errors, mistakes or inaccuracies on the Website or our social media pages; you acting or not acting, on any information contained on or referred to on the Website and/or any linked Website or our social media pages; personal injury or property damage of any nature resulting from your access to or use of the Website; any unauthorised access to or use of our secure servers and/or personal information and/or financial information stored on those servers; any interruption or cessation of transmission to or from the Website; any bugs, viruses, Trojan horses or other harmful code or communications which may be transmitted to or through our Website by any third party; and/or the quality of any product or service of any linked sites. Where any law (including the Australian Consumer Law) provides a guarantee which may not be lawfully excluded, our liability will be limited to that provided by law. Except as required by law, in no event shall we, our affiliates and related entities or our suppliers be liable for any loss or any special, incidental or consequential damages arising out of or in connection with our Website or this Agreement (however arising, including negligence). You agree to accept sole responsibility for the legality of your actions under the laws which apply to you. You agree that we, our affiliates and related entities or our suppliers have no responsibility for the legality of your actions.

PRivacy policy

By providing us with personal information, you acknowledge and agree to the following:

We only collect the information we need in order to perform our services (“Services”). We comply at all times with the Privacy Act 1988 (Cth) which regulates how personal information is handled including all your health details which are sensitive information. We will not disclose your personal information without your consent unless required due to a medical emergency, injury, health risk or similar and we will only do so to a qualified professional who is under the same duty of confidentiality.

The personal information you are providing is true and correct at the time you are providing it to us. You will notify us with any changes and keep it updated on a regular basis while you are using our Services. You can access your personal information by request at any time. We keep your personal information secure and do not use it for any purposes unrelated to our services. From time to time, we may use your personal information to contact you in relation to information on our Services. You can unsubscribe at any time or advise us that you withdraw your consent to these specific uses and be removed from any further marketing or information we may send.

ELIGIBLE USE

Our services are professional services and you confirm that you are of legal age to access and use Our Website and/or Our Booking Services and of legal capacity to agree to Our Terms.

BOOKING PROCESS & PAYMENT

You can make a booking through Our Website and payment will not be required upon booking. Once your booking is accepted and confirmed you will receive confirmation of your appointment by SMS, phone or email.

As the lead person making the booking, you are responsible for:

  • Full payment of the applicable Fee;

  • Ensuring the Practitioner has access to your Designated Premises if Services are to be delivered at your premises, which must, in all cases, represent a suitable space in which the Services can be performed, with all appropriate facilities (including, adequate lighting, cooling/heating);

  • Providing as necessary, any additional booking and information to other individuals participating in the Services booked; and

  • Ensuring the health and safety of the Independent Practitioner if at your Designated Premises.

Full payment of any services provided are due after the provision of service. All payments by credit card or debit card need to be authorised by the relevant card issuer. We may also need to use extra security steps via Verified by Visa. By making a booking you agree to provide complete, correct and true information including without limitation billing and payment information.

PRICES

The price of Services varies according to the type and duration of the Service you book and also the location of the premises you have designated for the Treatment to be provided to you. Prices are set from time to time and the Price you will be required to pay for a specific Service will be determined by reference to the Prices in force at the date when that Service is booked.

Please note that all fees and charges are inclusive of GST.

CUSTOMER RESPONSIBILITIES

In addition to the responsibilities noted above, it is your responsibility to provide complete and accurate information at the time of booking. Failure to provide complete and accurate information may result in a rejection of your booking request, cancellation of your booking or an inability of the booked Practitioner to provide the Service as requested. Such failure may also result in loss or incorrect delivery of your booking confirmation.

CANCELLATION POLICY

We understand that life happens and request that cancellation requests be made at least 12 hours in advance from the time of Service. Should we be required to reschedule your appointment then we will also endeavour to cancel your appointment at least 12 hours in advance.

EXTENSIONS AND DELAYS

If you wish to extend the time you have booked, the Practitioner will endeavour to fulfil your request. This subject to the availability of the Practitioner and also payment of an additional charge for the extended time calculated in accordance with the Prices (each an "Extra Time Charge" and collectively, "Extra Time Charges").

If you are delayed and unable to start the Services at the Designated Premises at the time by more than 10 minutes then, unless the Practitioner agrees to the contrary (which is within the sole discretion of the Independent Practitioner):

  • the Practitioner is entitled to end the Services at the time agreed when the booking was made without making any adjustment to the Fee to reflect the reduced time of the Service; or

  • if you and the Practitioner agree to proceed with the Services for the full time allotted notwithstanding the delayed start time, then the Practitioner shall be entitled to receive and you shall be obliged to pay before the relevant Service is given, an additional charge calculated at the rate set out with the Prices for extra time.

FORCE MAJEURE

Every effort is made by the Simply Mint Massage team to provide the service booked by you, the customer. However some circumstances beyond our control may prevent this. Examples include (but not limited to) the following, all of which make it impossible to meet our obligations;

  • Adverse or severe weather conditions such as floods or earthquakes

  • Road traffic accidents

  • Unforeseen traffic delays or road closures

  • Warfare and acts of terrorism (and threat thereof)

  • Industrial dispute and labour strikes action

  • Civil strife

  • Problems caused by other customers

  • Significant risk to human health such as the outbreak of serious disease

  • Natural or nuclear disaster

  • Fire, chemical or biological disaster

  • Unavoidable technical problems

  • All similar events outside of Simply Mint Massage's control

If our obligations are affected by force majeure then will not refund the cost of the booking, pay you compensation or be liable. For the purposes of these booking conditions Force Majeure means any event beyond our control, the consequence of which could not have been avoided even if all reasonable measures had been taken.

If it was not possible to provide the booked service at the time requested due to Force Majeure, Simply Mint Massage will try to reschedule your appointment for another time. However, if this is not possible, a voucher of equal value to the postponed appointment will be provided for reclamation with Simply Mint Massage for up to 1 year.

PROMO CODES AND REFERRALS

We may from time to time create and offer promotional codes and referral codes (together "Codes") that can be redeemed on the Site against purchases of Services. Codes will only be valid for a period of time stated on or with them.

Codes do not have any cash value. Codes may:

(1) only be used for personal and noncommercial purposes. You can share your unique code with your personal connections via social media where you are the primary content owner. Codes may not be duplicated, sold, transferred, distributed or made available to others online (including through public sites such as coupon sites) or by other means;

(2) not be promoted in any way including via a Search Engine;

(3) not be exchanged for cash;

(4) only be used once and only one Code may be used per person; and

(5) may be subject to specific terms which will be made available by us, and must only be used in accordance with those terms.

INFECTIOUS DISEASE POLICY (INCLUDING COVID-19)

We encourage hygiene practices before, during and after Services.

Before your appointment, if you have arrived from overseas or any Hotspots within Australia please let us know PRIOR to your appointment and we will request to reschedule. You should not visit if you have:

  • returned from overseas in the last 14 days;

  • been in contact with a confirmed case of COVID-19 in the last 14 days;

  • a fever or symptoms of acute respiratory infection (e.g. cough, sore throat, runny nose, shortness of breath).

Upon arrival at the Premises there will be hand sanitizer supplied for use and clients will have the opportunity to sign in using handwritten mandatory contact register form.

We will not ask for your vaccination status as that is private information between you and your Health Practitioner however it is advised that you should avoid any massage until 30 days after any vaccination (due to potentially heightened sensitivity of the skin and potential complications that may arise from being vaccinated).

After your service we anticipate a 15 minute gap between the coming and going of one client and another. We may restrict clients from entering while another client is exiting.

‍PROHIBITED USE

You must not conduct any of the following which are strictly prohibited:

  • Engage in any inappropriate behaviour including but not limited to illicit or sexually suggestive remarks, sexual advances, drug use, excessive drinking and/or other inappropriate behaviour;

  • Restrict or inhibit any other user from using and enjoying Services;

  • Infringe the privacy rights, property rights, or other civil rights of any person;

  • Harass, abuse, threaten or otherwise infringe or violate the rights of our Practitioners, (including its employees and personnel) or others;

  • Harvest, data-mine or otherwise collect information about others, including email addresses, without their consent;

  • Use technology or other means to access our computer network, unauthorised content or non-public spaces;

  • Introduce or attempt to introduce any viruses or any other harmful code, files or programs that interrupt or otherwise or limit Our Booking Services functionality;

  • Damage, disable or otherwise impair our servers or networks or attempt to do the same; and

  • Engage in or encourage others to engage in criminal or unlawful conduct or breach these Terms including misuse of Our Booking Services for unlawful or unauthorised purposes.

You agree not to breach these Terms in any way which may result in, among other things, termination or suspension of your access to Our Booking Services.

INTELLECTUAL PROPERTY

Simply Mint Massage, the logo, brand and all other intellectual property rights, trademarks, service marks, graphics and logos used in connection with Our Website and/or the Services (whether registered or unregistered) belong to us or our licensors (as are applicable) and are protected by intellectual property law. Nothing in these Terms grants you any rights in the Site or Booking Services or the content within the same. All rights are reserved.
